Mayor Introduces Ordinance Requiring Liability Insurance for Gun Owners

The mayor of San Jose, California has just introduced a proposed city ordinance that would require legal gun owners to either purchase liability insurance for their firearms or pay a fee to the city that supposedly helps defray the public cost of gun violence.

Mayor Sam Liccardo introduced the proposed ordinance on Monday and is being touted by the mayor’s office as a first of it’s kind “harm reduction model.”

What it is of course is another barrier to gun ownership, especially among the poor, and a revenue stream for the city.

“A mayor doesn’t have the luxury of just offering ‘thoughts and prayers’—we have to solve problems. While this is far from a complete solution, it is something we can do to reduce the harms of firearms, without waiting for Congress to take action,” Liccardo said in a statement announcing the proposal.

“Under current Supreme Court rulings, the 2nd Amendment to the US Constitution protects the right to keep and bear arms. However, the Constitution does not require taxpayers to subsidize that individual choice. The cost of city police and emergency services required to address gun violence should be paid by gun owners, not all taxpayers.”

Here’s how the proposed “buy gun insurance or pay us” ordinance would work, at least in theory:

If passed by the San Jose City Council, the ordinance would mandate that all gun owners in the city obtain liability insurance for their firearms. The insurance would cover things such as the accidental discharge of a weapon, as well as the actions of a third party that intentionally steals or borrows an individuals gun.

The insurance would not cover a person’s intentional conduct with a firearm.

If the insurance is unavailable, or if a gun owner is unable to gain coverage, the ordinance offers the option for individuals to pay a fee that would go toward services including emergency medical help.

This of course is ridiculous and will do absolutely nothing to reduce gun violence. Criminals won’t follow the law, and the additional costs would mean the poorest among us would have to forgo their Second Amendment rights.

The proposed ordinance is nothing but a barrier to entry for gun ownership and will likely, if passed, at some point in the future, be deemed unconstitutional.

Democrats, in their rush to “do something” about gun violence don’t think about the consequences of their actions, and hurt the most vulnerable among us.

Democrats and their media allies should be ashamed of themselves, but they have no shame. None at all.
